Terms of Use

1. The Service

Pic by Pic is a party game you can play in a web browser or in our Android app. Players join a room with a code, respond to prompts by submitting photos, and vote anonymously for their favorites.

The Android app is offered as a download from our website, not through Google Play. It can download and offer new versions of itself, and game invite links may open directly in it. These Terms apply to the website and the app alike.

We may change, add or remove features, categories and prompts at any time, and we may suspend or stop the Service, with or without notice.

2. Who Can Play

You must be at least 16 years old to use the Service, or have the permission and involvement of a parent or legal guardian who agrees to these Terms on your behalf.

Hosts are responsible for who they invite to their rooms and for making sure the game is suitable for everyone playing.

3. 18+ Categories

Some categories are marked with an 18+ badge because their prompts are meant for adults. They are offered only when every player in the room has entered a year of birth showing they are 18 or older. If any player is under 18 or did not enter a year of birth, these categories are hidden for the whole room.

You agree to enter your real year of birth, or to leave it empty. Do not enter a false year of birth to unlock 18+ categories, and do not play 18+ categories with, or on behalf of, anyone under 18.

We do not verify ages. Each player is responsible for the year of birth they enter, and hosts are responsible for making sure their room is suitable for everyone playing.

4. Your Content

You keep all rights to the photos, names and text you submit ("Your Content").

By submitting Your Content, you give us a limited, non-exclusive, worldwide, royalty-free permission to store, process, convert and display it to the players in your room, only for the purpose of running the game. This permission ends when Your Content is deleted under our Privacy Policy.

You confirm that you have the right to share Your Content, and that it does not break the law or anyone else's rights. If a photo shows other people, make sure they are comfortable with it being shown to the room.

5. Rules of Play

Pic by Pic is meant to be fun for everyone. These rules apply in every category, including 18+ categories. You agree not to submit or share content that:

• Is sexually explicit, or shows nudity.
• Shows anyone under 18 in a sexual or suggestive way.
• Shows a person in a private or intimate situation, or was taken or shared without their consent.
• Harasses, bullies, threatens, defames or humiliates anyone.
• Contains hate speech, or promotes violence or discrimination.
• Infringes someone else's copyright, trademark or other rights.
• Is illegal, or promotes illegal activity.

Keep it friendly We may close rooms and block access to the Service for anyone who breaks these rules. Never submit photos of people who would not want them shown.

6. Using the Service Fairly

You also agree not to:

• Try to access rooms, data or systems you are not allowed to access.
• Interfere with or overload the Service, or use bots, scripts or scrapers on it.
• Copy, reverse engineer or resell the Service or its content, except as the law allows.
• Impersonate other people or pretend to be another player in a room.

7. Not a Storage Service

Photos and game data are deleted automatically after a game, as described in our Privacy Policy. Pic by Pic is not a backup or storage service, so keep your own copies of anything you want to keep. We are not responsible for content lost when a room is deleted or a connection drops.

8. Our Content

The Service, including its software, design, logo, artwork, prompts, categories and game mechanics, belongs to us or our licensors and is protected by law. We give you a personal, non-exclusive, non-transferable right to use the Service for playing the game, under these Terms.

Images shown through the in-app image search come from third-party providers (such as Unsplash and Pixabay) and remain subject to those providers' licenses.

9. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will be uninterrupted, error-free or secure, or that it will meet your expectations.

Content in game rooms is created by players, not by us. We do not review it in advance and are not responsible for what other players submit.

10. Limitation of Liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising from your use of the Service or from the conduct of other players.

Nothing in these Terms limits any liability that cannot be limited under applicable law.

11. Ending Your Use

You can stop using the Service at any time by leaving your room and closing the app. We may suspend or end your access if you break these Terms or if we need to in order to protect the Service or other players.

12. Governing Law

These Terms are governed by the laws of the State of Israel. Any dispute related to the Service or these Terms will be heard exclusively by the competent courts in Tel Aviv-Jaffo, Israel.

If any part of these Terms is found to be unenforceable, the rest will remain in effect.

13. Changes and Contact

We may update these Terms from time to time. When we do, we will change the "Last Updated" date above. If you keep using the Service after a change, you accept the updated Terms.
